Welcome to WedSpark. WedSpark is an online wedding vendor discovery, listing and connection platform and is a product of RiseCrest Solutions, our parent company.

Throughout these Terms & Conditions, the terms "WedSpark," "we," "us," and "our" refer to the WedSpark platform and the services provided through WedSpark as a product of RiseCrest Solutions.

By accessing, browsing, registering on, purchasing a subscription through, or otherwise using the WedSpark website and its related services, you agree to comply with and be bound by these Terms & Conditions.

Please read these Terms & Conditions carefully before using WedSpark. If you do not agree with these Terms, you should discontinue use of the website and services.

1. About WedSpark

WedSpark is a wedding vendor discovery and listing platform that helps customers discover and connect with independent wedding service providers.

The platform may include wedding professionals and businesses such as photographers, makeup artists, mehndi artists, decorators, wedding planners, caterers, venues, beauty professionals and other wedding-related service providers.

WedSpark is a product of RiseCrest Solutions. WedSpark is not intended to be represented as a separate legal entity from RiseCrest Solutions.

2. Nature of the Platform

WedSpark primarily provides an online platform through which customers can discover, view information about, and communicate with independent wedding vendors.

Unless expressly stated otherwise, WedSpark and RiseCrest Solutions do not directly provide the wedding services listed by independent vendors on the platform.

Vendors listed on WedSpark are independent businesses or service providers and are responsible for the services, products, pricing, availability, quality and commitments they offer to customers.

Any booking, service agreement, pricing arrangement, payment for a wedding service, cancellation, dispute or other transaction between a customer and a vendor is primarily between the customer and the respective vendor, unless WedSpark expressly states otherwise.

3. Acceptance of Terms

By accessing or using WedSpark, creating an account, submitting an inquiry, registering as a vendor, purchasing a subscription plan, making a payment, or using any other service provided through the platform, you acknowledge that you have read, understood and agreed to these Terms & Conditions.

If you are using WedSpark on behalf of a business or organization, you represent that you have the authority to accept these Terms on behalf of that business or organization.

4. Eligibility

You must be legally capable of entering into a binding agreement under applicable law to use services that require contractual or financial commitments.

By using WedSpark, you represent that the information you provide is accurate and that you have the legal capacity and authority required to use the applicable services.

5. User Responsibilities

Users agree to:

  • Provide accurate, current and complete information.
  • Keep account and login information secure.
  • Use WedSpark only for lawful purposes.
  • Not provide false, misleading or fraudulent information.
  • Not impersonate another person, business or organization.
  • Not misuse, disrupt or attempt to gain unauthorized access to WedSpark or its systems.
  • Not upload, publish or transmit unlawful, harmful, abusive, defamatory or infringing content.
  • Respect the rights, privacy and property of other users and vendors.
  • Not use WedSpark for unauthorized advertising, spam or activities unrelated to the intended purpose of the platform.

6. Vendor Responsibilities

Vendors who create or maintain a listing on WedSpark are responsible for ensuring that all information provided by them is accurate, lawful and up to date.

Vendors are responsible for:

  • Providing accurate business and contact information.
  • Providing accurate service descriptions and pricing.
  • Maintaining accurate availability information.
  • Providing genuine business information and portfolio content.
  • Ensuring that they have the necessary rights to use submitted photographs, logos, descriptions and other content.
  • Providing services to customers as agreed between the vendor and customer.
  • Handling customer communications professionally.
  • Complying with applicable laws, regulations and professional requirements.
  • Resolving service-related matters directly with customers where appropriate.

Vendors are solely responsible for the services, products, representations and commitments they offer or provide to customers.

7. Vendor Listings and Verification

WedSpark may review vendor information before or after publishing a vendor profile. Such review may be conducted for quality, safety, authenticity, platform management or other operational purposes.

However, the presence of a vendor listing on WedSpark does not by itself constitute a guarantee, certification, endorsement or warranty regarding the vendor's qualifications, services, pricing, availability, quality, reliability or performance.

WedSpark may modify, restrict, suspend or remove a vendor listing if information is inaccurate, misleading, fraudulent, unlawful, inappropriate, outdated or otherwise creates a risk to users, vendors, WedSpark or RiseCrest Solutions.

8. Customer Inquiries and Communication

WedSpark may provide features that allow customers to submit inquiries or contact relevant wedding vendors.

When a customer submits an inquiry, the information necessary to respond to that inquiry may be shared with the relevant vendor or vendors.

WedSpark does not guarantee that a vendor will respond to every inquiry, provide availability, accept a booking, or enter into a service arrangement with a customer.

Customers are responsible for reviewing vendor information, discussing requirements, confirming pricing and availability, and making their own decisions before engaging a vendor.

9. Payments and Payment Gateway Services

WedSpark may offer paid vendor subscription plans, membership plans, listing services, promotional services and other paid services.

Payments for WedSpark's paid services may be processed through third-party payment gateway and payment service providers, including Razorpay or other payment providers that may be made available on the platform.

When you make a payment through WedSpark, the payment transaction may be processed through the applicable payment gateway provider's systems. The payment gateway provider may process payment information in accordance with its own applicable terms, privacy policy, security requirements and applicable laws.

WedSpark and RiseCrest Solutions may receive limited transaction-related information from the applicable payment provider, such as transaction ID, payment status, payment amount, payment date, payment method information or other information necessary for payment confirmation, account management, invoicing, reconciliation, fraud prevention and customer support.

WedSpark does not intentionally store complete debit card, credit card, net banking or UPI credentials on its own servers. Payment credentials may be collected and processed directly by the applicable payment gateway or payment service provider.

10. Payment Authorization and Failed Transactions

By initiating a payment for a paid WedSpark service, you authorize the applicable payment provider to process the transaction for the amount displayed at the time of purchase.

A payment may fail, be declined, remain pending, be reversed or otherwise not be completed for reasons including payment-provider restrictions, insufficient funds, incorrect payment information, technical issues, bank restrictions, security checks or other circumstances outside WedSpark's direct control.

Where a transaction is shown as successful by the payment provider but the corresponding WedSpark service is not activated or updated, the transaction may be reviewed using the available transaction information.

11. Pricing and Taxes

Prices for WedSpark subscription plans and other paid services will be displayed on the website before purchase.

Unless otherwise stated, prices are displayed in Indian Rupees (INR).

Applicable taxes, government charges or other applicable fees will be displayed or applied where required before completion of the purchase.

WedSpark may change pricing, plans or service fees from time to time. Any applicable price change will generally apply to future purchases or renewals unless otherwise stated.

12. Subscription and Membership Plans

Vendors may choose from subscription or membership plans offered through WedSpark. Different plans may provide different features, listing benefits, validity periods, visibility, lead limits or other benefits.

The applicable plan name, pricing, validity period, features and limitations will be displayed before the vendor completes the purchase.

Subscription benefits are available according to the selected plan and its applicable validity period.

Unless expressly stated otherwise at the time of purchase, purchasing a subscription does not guarantee any minimum number of customer inquiries, leads, bookings, sales, revenue or business results.

13. Refunds and Cancellations

Refunds, cancellations and payment-related issues for WedSpark's paid services are handled according to the separate Refund & Cancellation Policy published on the WedSpark website.

Users and vendors should review the Refund & Cancellation Policy before purchasing any paid service or subscription plan.

Where a refund is approved, the refund may be processed through the applicable payment gateway or payment service provider and may be subject to the processing time of the relevant bank, payment network or payment provider.

14. Chargebacks and Payment Disputes

If you believe that a payment has been made incorrectly, duplicated, unauthorized or otherwise requires review, you should contact WedSpark using the available support or contact channels as soon as reasonably possible.

WedSpark may review payment records and transaction information and may communicate with the applicable payment gateway or payment service provider where necessary to investigate a payment-related issue.

Nothing in these Terms prevents a user from exercising any rights or remedies available under applicable law or applicable payment-provider rules.

15. Intellectual Property

Unless otherwise stated, the WedSpark name, branding, logo, website design, graphics, text, software, layouts, interfaces and other original content provided by WedSpark are owned by or licensed to RiseCrest Solutions and are protected by applicable intellectual property laws.

You may not copy, reproduce, modify, distribute, publish, sell, license, create derivative works from or commercially exploit WedSpark's proprietary content without prior written permission, except where permitted by applicable law.

16. Vendor-Submitted Content

Vendors may upload or submit business descriptions, photographs, logos, service information, pricing, portfolio materials, videos, reviews or other business-related content to WedSpark.

Vendors represent and warrant that they have the necessary rights, permissions and authority to submit such content and that the content does not infringe the copyright, trademark, privacy, publicity or other legal rights of any third party.

By submitting content to WedSpark, vendors grant WedSpark, as a product of RiseCrest Solutions, a non-exclusive, royalty-free right to use, display, reproduce, format, publish and distribute such content as reasonably necessary to operate, provide, maintain, improve and promote the WedSpark platform, subject to applicable law and our policies.

WedSpark may remove or restrict content that violates these Terms, applicable law, our policies or the rights of another person or organization.

17. Prohibited Activities

Users and vendors must not use WedSpark to:

  • Commit, promote or facilitate unlawful activities.
  • Submit fraudulent, false or misleading information.
  • Harass, threaten, abuse or intimidate other users or vendors.
  • Upload malicious software, harmful code or other harmful material.
  • Attempt unauthorized access to accounts, systems or infrastructure.
  • Send spam or unauthorized promotional communications.
  • Infringe copyright, trademark, privacy or other legal rights.
  • Collect or misuse personal information of other users without authorization.
  • Manipulate listings, reviews, inquiries or other platform features dishonestly.
  • Use automated systems to scrape, copy or collect WedSpark content without authorization.
  • Use WedSpark for purposes unrelated to its intended services.

18. Third-Party Services and Links

WedSpark may integrate with or contain links to third-party websites, payment providers, analytics platforms, advertising platforms, social media platforms, communication services, hosting providers and other external services.

These third-party services may operate independently and may have their own terms, privacy policies, security practices and other applicable conditions.

Where WedSpark uses third-party services such as payment gateways, analytics providers, advertising technologies or communication services, your use of those services may also be subject to the applicable third-party provider's terms and policies.

WedSpark and RiseCrest Solutions are not responsible for the independent operation, availability, content, policies or security practices of third-party websites or services, except to the extent required by applicable law.

19. Advertising, Analytics and Meta Technologies

WedSpark may use third-party analytics, advertising and measurement technologies to understand website usage, improve services, measure marketing performance and provide relevant advertising or promotional activities where applicable.

These technologies may include cookies, pixels, tags, software development tools, conversion measurement tools or similar technologies provided by third-party platforms, including Meta and other advertising or analytics providers.

Such technologies may process information such as browser information, device information, pages visited, actions taken on the website, approximate location information, referral information and other technical or event-related information, subject to applicable laws and the relevant provider's policies.

The use of such technologies is also described in our Privacy Policy.

WedSpark does not intentionally use advertising or analytics technologies to collect complete debit card, credit card, net banking or UPI credentials.

20. Privacy

Your use of WedSpark is also subject to our Privacy Policy, which explains how WedSpark, as a product of RiseCrest Solutions, collects, uses, stores, protects and discloses information.

By using WedSpark, you acknowledge that you have reviewed the Privacy Policy and understand how information may be handled in connection with the platform and its services.

21. Reviews, Ratings and User Content

WedSpark may provide features that allow users to submit reviews, ratings, comments, photographs or other content relating to vendors or platform experiences.

Users must ensure that submitted content is truthful, relevant and does not violate the rights of another person or organization.

WedSpark may remove, restrict or moderate user content where it reasonably believes that such content violates these Terms, applicable law or platform policies.

22. Platform Availability

We aim to keep WedSpark available and functional, but we do not guarantee that the website, features, listings or services will always be available, uninterrupted, secure or free from errors.

WedSpark may temporarily suspend or restrict access for maintenance, upgrades, security reasons, technical issues, operational requirements or circumstances beyond our reasonable control.

23. Limitation of Liability

WedSpark provides a platform for discovering and connecting with independent wedding vendors. We do not directly control or guarantee the quality, legality, availability, pricing, reliability, suitability or completion of services provided by independent vendors.

To the extent permitted by applicable law, WedSpark and RiseCrest Solutions shall not be responsible for disputes, losses, damages, delays, cancellations, service failures, misrepresentations or dissatisfaction arising from services directly provided by independent vendors.

Users are responsible for conducting their own discussions, verification, negotiations and arrangements with vendors before engaging their services.

Nothing in these Terms is intended to exclude or limit any liability that cannot lawfully be excluded or limited under applicable law.

24. Indemnification

To the extent permitted by applicable law, users and vendors agree to be responsible for claims, losses, liabilities, damages, costs or expenses arising from their violation of these Terms, unlawful conduct, misuse of WedSpark, infringement of third-party rights, or content submitted by them to the platform.

25. Account Suspension and Termination

WedSpark reserves the right to suspend, restrict or terminate an account, vendor listing or access to the platform if a user or vendor violates these Terms & Conditions, engages in fraudulent or abusive activity, provides misleading information, misuses the platform, creates a security risk or violates applicable laws.

WedSpark may also remove or restrict content, listings or accounts where reasonably necessary to protect users, vendors, WedSpark or RiseCrest Solutions.

Suspension or termination does not automatically cancel any obligations that accrued before the suspension or termination, including applicable payment obligations or obligations that by their nature should continue after termination.

26. Electronic Communications

By using WedSpark or providing your contact information, you agree that we may communicate with you electronically regarding your account, transactions, inquiries, subscriptions, security, service updates and other necessary matters.

Where applicable and permitted by law, you may also receive marketing or promotional communications. You may manage marketing communications using the available unsubscribe or communication preference options.

27. Changes to These Terms

WedSpark, as a product of RiseCrest Solutions, may update or modify these Terms & Conditions from time to time to reflect changes in our services, technology, business practices or legal requirements.

Any updated version will be published on this page with the revised Last Updated date.

Your continued use of WedSpark after updated Terms are published may constitute acceptance of the revised Terms, to the extent permitted by applicable law.

28. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the applicable laws of India.

Any disputes relating to the use of WedSpark, subject to applicable law, shall be subject to the jurisdiction of the competent courts in India.
